Agreement

These terms are an agreement between you and Asynk Tech LTD, 167–169 Great Portland Street, London W1W 5PF, United Kingdom ("we", "us"), for the Nightfun app and the browser guest pages at https://party.mobiforge.dev. By using Nightfun you accept these terms and our privacy policy. If you do not accept them, do not use Nightfun.

Who can use it

You must be at least 13 years old, or the minimum age in your country if it is higher. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you.

The service

Nightfun is a collection of party games. You can play on one phone that you pass around, or in a room where each player uses their own phone or browser. The server runs the games, so you need an internet connection. We can change, add or remove games, packs and features, and we can stop the service, at any time.

Nightfun is free in this version. If we add optional purchases later, extra terms will apply to them and we will show them before you buy.

Play fair and be kind

When you use Nightfun, you agree not to:

• choose a nickname that is offensive, hateful, sexual, threatening, or that pretends to be someone else, or that contains personal information about another person;
• harass or bully other players, or use the games to target a real person;
• cheat, attack, overload, reverse engineer or get unauthorised access to the service or other players' rooms;
• use bots or scripts to join rooms or play;
• use Nightfun for any unlawful purpose.

The host can remove players from a room. We can suspend or block an installation that breaks these rules.

Content and intellectual property

The games, cards, texts, artwork, name and logo of Nightfun belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use Nightfun for your own, non-commercial entertainment. You may not copy, sell or redistribute the content.

The cards are humour for adults and teens at a party. Some cards talk about dating, family life and nights out. They are fiction and do not describe real people. You choose the packs and you are responsible for playing them with people who are comfortable with them.

If you think content in Nightfun is wrong, offensive or infringes your rights, write to support@asynk.tech.

Apple App Store

If you downloaded Nightfun from the App Store, these terms are between you and us, not Apple. Apple has no obligation to maintain or support the app and is not responsible for claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Apple's Licensed Application End User License Agreement also applies, and where it conflicts with these terms, Apple's terms apply for the App Store version.

No warranty

Nightfun is provided "as is" and "as available". To the extent the law allows, we do not promise that it will be uninterrupted, error-free or that games will always be available. Nothing in these terms limits rights you have as a consumer that cannot be limited by contract.

Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of data, profit or goodwill. Our total liability to you for any claim about Nightfun is limited to the greater of the amount you paid us in the 12 months before the claim and USD 50. We do not limit liability for death or personal injury caused by negligence, for fraud, or where the law does not allow it.

Ending

You can stop using Nightfun at any time and delete your data from the app or by email (see Delete your data). We can suspend or end your access if you break these terms or if we stop the service.

Governing law

These terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, but if you are a consumer you can also bring a claim in the courts of the country where you live, and you keep the protection of its mandatory laws.

Changes and contact

We may update these terms. We will change the date on this page and, for important changes, tell you in the app. If you keep using Nightfun after a change, the new terms apply. Questions: support@asynk.tech.
